These Terms and Conditions govern the provision of services by Ever Ready Solutions Pty Ltd (“Ever Ready Solutions”, “we”, “us”, “our”) and apply to all inspections, quotations, restoration works, remediation services, cleaning services, testing, reporting, and related activities undertaken by us. By engaging our services, requesting a quote, accepting a proposal, or allowing works to commence, you agree to be bound by these Terms and Conditions.

Ever Ready Solutions provides specialised services including, but not limited to, mould remediation, water damage restoration, fire and smoke damage restoration, biohazard and forensic cleaning, drug and methamphetamine decontamination, needle and sharps removal, hoarding and gross filth cleaning, moisture inspections, mould testing, air cleaning, sanitisation, exterior cleaning, and related restoration and remediation services. All services are provided in accordance with industry best practice, applicable Australian standards, and relevant guidelines where reasonably practicable.

Any inspection, assessment, or quotation provided by Ever Ready Solutions is based on conditions that are visible and accessible at the time of inspection. Clients acknowledge that restoration and remediation works often involve concealed or hidden conditions that may not be identifiable until works commence or materials are removed. As a result, additional works, variations, or changes to scope may be required if further damage, contamination, or deterioration is discovered. Ever Ready Solutions reserves the right to revise the scope, methodology, and pricing to address such conditions, subject to client approval where required.

Quotes provided by Ever Ready Solutions are valid only for the period stated on the quotation and are based on the information available at the time. Unless otherwise stated, quotes are not fixed-price guarantees and may be subject to variation due to unforeseen site conditions, additional contamination, changes in access, delays, or client-requested changes. Acceptance of a quote authorises Ever Ready Solutions to carry out the works described within the agreed scope.

Where services are delivered in stages, including but not limited to make-safe works, remediation, drying, cleaning, and post-remediation activities, each stage is treated as a separate component of the overall service. Completion of one stage does not imply completion of all works required at a site. Building works, reinstatement, or cosmetic repairs, including plastering, painting, cabinetry, flooring, or structural repairs, are not included unless explicitly stated in writing. Responsibility for reinstatement typically rests with a licensed builder or tradesperson engaged separately.

Ever Ready Solutions does not guarantee that mould, microbial growth, odours, or contamination will not return following remediation. Clients acknowledge that mould and contamination are symptoms of underlying moisture, ventilation, structural, or environmental issues. Long-term prevention depends on rectification of contributing factors such as leaks, condensation, humidity, ventilation, and building defects, which may fall outside the scope of our services. Ever Ready Solutions is not responsible for recurrence where contributing factors persist or reoccur.

All services are performed using professional equipment, methodologies, and products appropriate to the scope of works. However, clients acknowledge that restoration and remediation involve inherent risks, including disturbance of materials, release of particulates, or temporary inconvenience. While reasonable care is taken to minimise disruption, Ever Ready Solutions is not liable for minor cosmetic impacts, pre-existing damage, or conditions outside our control.

Clients are responsible for providing safe, clear, and unrestricted access to the work area, including access to power, water, and suitable working conditions. Clients must remove or secure personal belongings, valuables, pets, and sensitive items prior to commencement of works. Ever Ready Solutions is not responsible for loss or damage to items left within the work area unless caused by proven negligence.

Payment terms are as stated on the invoice or quotation. Unless otherwise agreed in writing, payment is due in accordance with the specified timeframe. Ever Ready Solutions reserves the right to suspend or cease works where payment is overdue. Any costs incurred in recovering unpaid amounts, including administrative and legal costs, may be recoverable from the client.

Where services are arranged through insurers, property managers, body corporates, or government agencies, the client remains ultimately responsible for payment unless otherwise agreed in writing. Acceptance of works or authorisation to proceed confirms responsibility for charges not covered by third parties.

Reports, photographs, test results, and documentation provided by Ever Ready Solutions are prepared for the specific purpose of the engagement and are based on conditions at the time of inspection or service. Such documents are not warranties or guarantees and should not be relied upon for purposes beyond their intended scope. Distribution of reports to third parties is permitted only where reasonably required for the job, such as insurers, property managers, or regulatory bodies.

To the extent permitted by law, Ever Ready Solutions’ liability is limited to the cost of the services provided. We are not liable for indirect, consequential, or economic loss, including loss of rent, loss of use, business interruption, or delay damages, except where required by law. Nothing in these Terms and Conditions excludes or limits rights that cannot be excluded under Australian Consumer Law.

Ever Ready Solutions may subcontract all or part of the works to suitably qualified subcontractors where necessary. All subcontracted works remain subject to these Terms and Conditions.

By proceeding with an enquiry, accepting a quotation, or engaging Ever Ready Solutions to perform services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
